Welcome to WaterMark Tour Switzerland (“WaterMark,” “we,” “our,” or “us”). By confirming a reservation, booking, or payment with WaterMark Tour Switzerland, the client (“you,” “traveler,” or “guest”) acknowledges full acceptance of these Terms & Conditions. Please read them carefully before finalizing any booking.
1. Booking & Reservations

All bookings are subject to written confirmation and availability.

A booking is considered legally binding once WaterMark issues written confirmation and receives the required deposit.

Guests are responsible for ensuring that all personal and travel information provided (e.g., passport names, travel dates, dietary needs, and contact details) is accurate.

WaterMark reserves the right to decline or cancel a booking at any time prior to departure if payment conditions are not met or information provided is incomplete or incorrect.
2. Payments
-
A non-refundable deposit of 50% of the total tour cost is due at the time of booking.
-
The remaining balance must be received no later than 2 or 15 days (depending on tour) before the tour start date.
-
Payments may be made by bank transfer, credit card, or secure online payment link.
-
All prices are quoted in Swiss Francs (CHF) and include Swiss VAT where applicable.
-
Late or incomplete payments may result in automatic cancellation without refund.
3. Cancellations & Refunds
Client Cancellations
For Single-Day Tours:
-
More than 72 hours before departure: Full refund, minus a 10% administrative fee.
-
48–72 hours before departure: 50% of total tour price charged.
-
Less than 48 hours before departure or no-show: 100% of total tour price charged.
For Multi-Day Tours (including any tour with overnight stays or hotel bookings):
-
More than 15 days before departure: Full refund, minus the non-refundable deposit (to cover administrative and supplier costs).

0–15 days before departure: 100% of total tour price charged.
No refunds are provided for unused services, missed activities, or early termination of the tour once travel has commenced.
Company Cancellations
If WaterMark Tour Switzerland must cancel due to weather, safety, or operational reasons, guests may choose between:

A full refund of all payments received, or
-
A rescheduled date or credit of equal or higher value.
Note: WaterMark Tour Switzerland is not responsible for incidental or third-party expenses such as flights, visas, or independently booked accommodations.
4. Itinerary & Services

All itineraries are subject to change due to weather conditions, safety, availability, or operational requirements.

WaterMark reserves the right to modify or substitute activities, accommodations, or routes with equal or superior alternatives without prior notice.

Any modifications made are executed with the intent to maintain or exceed the agreed standard of quality.
5. Inclusions & Exclusions
Included (unless stated otherwise):

Private luxury vehicle transfers and transportation
-
Licensed professional driver-guide
-
Activities, entrance fees, and experiences listed in the confirmed itinerary
Not Included (unless specified):
-
International or domestic flights
-
Meals and beverages not expressly mentioned

Personal expenses and gratuities
-
Travel insurance
-
Any additional services requested after booking confirmation
6. Traveler Responsibilities
-
Clients must hold valid passports, visas, permits, and health documentation as required.

Guests are expected to behave respectfully toward guides, staff, and local communities at all times.

WaterMark reserves the right to remove any traveler from a tour, without refund, in cases of misconduct, illegal activity, intoxication, or endangerment to others.

Any expenses resulting from missed departures, delayed arrivals, or personal negligence are the traveler’s responsibility.
7. Insurance

Comprehensive travel insurance is mandatory for all clients. Coverage should include medical, cancellation, interruption, delay, and personal property protection.

WaterMark assumes no liability for costs arising from illness, accident, cancellation, or other unforeseen events.
-
Proof of insurance may be requested before the tour commences.
8. Liability & Force Majeure

WaterMark acts solely as a tour organizer and may rely on services provided by independent third parties (e.g., hotels, restaurants, transportation companies, and activity providers).

While we carefully select partners, WaterMark cannot be held liable for acts, omissions, negligence, or defaults of any third party.

WaterMark is not responsible for delays, cancellations, or losses caused by force majeure events, including but not limited to natural disasters, pandemics, strikes, political unrest, acts of terrorism, or extreme weather.

In the event of such occurrences, no refund or compensation will be issued. However, WaterMark will make reasonable efforts to reschedule services or provide suitable alternatives.
9. Privacy & Data Protection

All personal information provided is handled in accordance with Swiss Federal Data Protection Law (FADP) and used solely for operational, legal, or safety purposes.

Data will never be sold, traded, or disclosed to unauthorized third parties.
-
Clients consent to the use of photographs or videos taken during the tour for promotional purposes unless explicitly declined in writing before departure.
10. Governing Law & Jurisdiction
-
These Terms & Conditions shall be governed exclusively by Swiss law.
-
The place of jurisdiction for any dispute, claim, or legal action shall be Rorschach, Canton St. Gallen, Switzerland, unless otherwise required by mandatory Swiss law.
-
The invalidity of any clause does not affect the validity of the remaining provisions.
